Terms of Service

These Terms of Service (“Terms”) govern your access to and use of HexUGC (the “Service”), which uses third-party artificial-intelligence models — including Google's Gemini image models — to generate avatars, images, voiceovers, and short-form video from the inputs you provide. By creating an account, clicking “I Agree,” or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet this requirement and that all information you provide is accurate.

2. Acceptable Use & Prohibited Content

The Service generates content using Google's generative-AI models. You agree to comply with Google's Generative AI Prohibited Use Policy, which is incorporated into these Terms by reference. In particular, you must not use the Service — including any prompt, uploaded image, reference video, or generated output — to create, upload, or distribute:

• Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors;
• Sexually explicit or pornographic content, or content created for the purpose of sexual gratification;
• Non-consensual intimate imagery, sexual deepfakes, or any depiction of an identifiable person created without their consent;
• Content that harasses, bullies, threatens, defames, or incites hatred or violence against any person or group;
• Content depicting graphic violence, self-harm, or terrorist or violent-extremist material;
• Content that impersonates a person or entity, or that is deceptive, fraudulent, or misrepresents its AI-generated origin in a way intended to deceive;
• Content that infringes the intellectual-property, privacy, or publicity rights of others; and
• Content that facilitates illegal activity, malware, spam, phishing, or the circumvention of any safety filter.

You are solely responsible for your inputs and for your use of any generated output, including any use or distribution by people you share it with. You must obtain all rights and consents necessary for any image, likeness, voice, brand, or product you submit.

3. Enforcement, Suspension & Termination

We may monitor use of the Service for compliance and may remove content, refuse generation requests, and suspend or terminate your account — with or without notice — if we believe you have violated these Terms or the Google Prohibited Use Policy, or to comply with law. We may report suspected unlawful content to Google, our providers, and law-enforcement authorities. No refund of credits is owed for content or accounts removed for a violation.

4. Credits & Billing

Generation consumes credits, which are granted through subscription plans or one-off purchases. Credits have no cash value and are non-transferable. Pricing and plan details are described on our pricing page and at checkout.

5. Your Content & Outputs

You retain the rights you hold in the inputs you submit. Subject to these Terms and the policies of our underlying AI providers, outputs you generate are yours to use. AI-generated output may be inaccurate or unexpected; you should review it before relying on or publishing it, and you are responsible for ensuring its lawful use.

6. Indemnification

You agree to defend, indemnify, and hold harmless HexUGC and our service providers (including Google) from and against any claims, damages, liabilities, and costs (including reasonable legal fees) arising out of or related to your inputs, your generated output, your use of the Service, or your breach of these Terms or the Google Prohibited Use Policy.

7. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, HexUGC will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of, or inability to use, the Service or any generated output.

8. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will revise the version and effective date above and may require you to accept the updated Terms before continuing to use the Service.
